Terms of service

The rules that keep the marketplace fair. Written to be read, not skimmed past.

1. Agreement to these terms

These terms of service govern your access to and use of BAHHR: the mobile app, this website, and every related service we provide.

By creating an account, signing in, listing a vehicle, requesting a booking, or otherwise using BAHHR, you agree to these terms. If you do not agree to them, do not use the service.

These terms are read together with the privacy policy, which explains what personal data we process and why. Both apply to your use of BAHHR.

2. What BAHHR is, and what it is not

BAHHR is a marketplace. It connects people who own boats, jet skis, ATVs, dirt bikes, buggies and motorcycles with people who want to rent or buy them.

BAHHR does not own, operate, maintain, insure or take possession of any vehicle listed on the platform. The rental agreement forms directly between the owner and the renter, and BAHHR is not a party to it. Our role is discovery, scheduling, communication, payment infrastructure and dispute mediation.

Nothing on BAHHR is professional advice, whether legal, financial, mechanical or maritime. Listing content is supplied by owners and reflects their own judgement. We review listings before they go live, but that review is not an inspection, a survey or a safety certification.

3. Eligibility and your account

You must be at least 18 years old and able to enter into a binding contract under the laws of the Kingdom of Saudi Arabia. You confirm that you meet this requirement when you create an account, and you must be able to prove it on request.

  • Give accurate information when you sign up, and keep it current.
  • Hold the licence required for any vehicle you intend to operate, and carry it during the rental.
  • Keep your password and your device secure. You are responsible for activity under your account.
  • Use one account per person. Opening a second account to escape a suspension is a breach of these terms.

Tell us immediately if you believe someone else has used your account. We may suspend or close any account that breaches these terms, that we reasonably suspect of fraud or abuse, or that we are required to suspend by law or by a regulator.

4. Identity and licence verification

Parts of BAHHR are gated behind identity checks. We may ask you to verify your phone number with a one time code, to upload a government identity document (national ID, Iqama or passport), and to upload a valid driving licence.

Documents are reviewed by our team. We may approve or reject a document, and we will give the reason for a rejection so that you can submit it again. A verified badge on a profile means those checks passed when they were run. It is not a guarantee of any person’s conduct, skill or solvency.

An owner can mark a listing as requiring an approved driving licence. Where they do, a booking request from a renter without one is refused.

Identity documents are stored privately and are visible only to the staff who review them. The privacy policy explains how they are handled and how long they are kept.

5. Listing a vehicle

If you list a vehicle, you confirm that you own it or are otherwise authorised to rent it out or sell it. As an owner you agree to:

  • Keep the listing accurate: photographs of the actual vehicle, real pricing, correct location, capacity, year and condition.
  • Hold the registration, licensing and insurance that Saudi law requires for the vehicle and for the use you are offering.
  • Hand over a vehicle that is roadworthy or seaworthy, clean, fuelled as agreed and safe to use.
  • Provide the safety equipment the law requires, including life jackets on the water.
  • Answer booking requests within a reasonable time, and honour every booking you accept.
  • Declare and pay any tax due on what you earn through BAHHR. BAHHR does not file or withhold tax on your behalf.

Every listing is reviewed before it can be booked, typically within 24 hours. We may reject a listing, pause it, or ask for changes, and we will tell you why. We may remove a listing that breaches these terms, that is unlawful, or that we reasonably believe is unsafe.

The pickup location you set on a listing is shown publicly on the map. Do not set it to a private address that you are not willing to publish.

6. Bookings and time slots

BAHHR books hours, not days. A booking is a time slot with a start and an end.

  • The owner sets the daily availability window, the minimum booking length (two hours by default) and a buffer between bookings for handover, cleaning and refuelling.
  • Owners can block individual dates on which the vehicle cannot be booked.
  • A slot can be held by one booking only. Overlapping requests are refused automatically.
  • A request is not confirmed until the owner accepts it.

When you request a booking you are offering to rent that vehicle on the terms shown at checkout. The rental agreement forms when the owner accepts.

7. How a rental runs

  • Pending. The renter has requested the slot and the owner has not answered yet.
  • Confirmed. The owner has accepted and the slot is held.
  • Awaiting pickup. The owner has started the booking at handover. This can be done up to 15 minutes before the scheduled start time, and no earlier.
  • Active. The renter has confirmed that they have the vehicle.
  • Completed. The rental has finished and the review window opens.

The owner cannot mark a rental complete before its scheduled end time. The renter can, by returning the vehicle early. Returning early does not by itself create a refund.

Both parties should photograph the vehicle at handover and again at return. In a dispute we give real weight to photographs taken at the time, and very little to recollection.

8. Prices, fees and VAT

Owners set their own prices, quoted in Saudi riyals. Every charge is itemised before you confirm a booking. We do not charge anything you have not seen first.

Value added tax is applied at the rate in force in the Kingdom, currently 15%, and is shown as its own line. We may change our own fees, and we will publish any change at least 30 days before it takes effect. The fees that apply to a booking are the fees that were shown when that booking was made.

9. Payment and payouts

The renter pays the full amount at the time of booking, using the payment methods offered in the app.

The owner is paid after the rental is completed, less the owner fee, to the payout details the owner has registered with us. A payout may be held while a dispute, a chargeback or a fraud review is open.

We may reverse a payment, hold a payout, or charge an additional amount where there is evidence of fraud, chargeback abuse, unpaid damage or fines, or a material breach of these terms.

BAHHR is not a bank, a payment institution or a money transmitter. Card processing is carried out by licensed payment providers, and their own terms apply to that processing.

10. Cancellations and refunds

Cancellations follow the policy in force when the booking was made. The current policy is:

An owner who cancels a confirmed booking triggers a full refund to the renter whatever the timing, and repeated cancellations may affect that listing’s standing on the platform.

Refunds are returned to the original payment method. How long they take to appear depends on the issuing bank. Fees are refunded in the same proportion as the rental amount.

If a vehicle is not as described, is unsafe, or is not handed over at all, raise it with us before the slot ends. Do not simply walk away. We can only act on a booking while we can still see what is happening.

11. Use, damage and fines

As a renter you agree to:

  • Use the vehicle only as the listing describes, and only within the law.
  • Not let anyone else operate it unless the owner has agreed in writing in the app chat.
  • Not operate any vehicle under the influence of alcohol or drugs, and not carry anything unlawful.
  • Observe the passenger capacity stated in the listing, and use the safety equipment provided.
  • Return the vehicle on time, in the condition you received it, allowing for fair wear and tear, with the agreed fuel level.

You are responsible for loss of or damage to the vehicle during your rental window, and for traffic fines, maritime penalties, tolls, impound charges and recovery costs incurred during it. We may charge the payment method on file, offset the amount against a refund owed to you, or pursue the amount directly.

Where a booking includes any cover, what that cover does and does not include is set out at checkout before you pay.

The owner remains responsible for damage or loss that existed before your rental, and for mechanical failure that your use did not cause.

12. Vehicles listed for sale

Some listings are offered for sale as well as, or instead of, for rent. Contacting a seller opens a conversation in the app.

BAHHR does not act as an escrow agent for a sale. Payment, handover, ownership transfer and registration happen directly between buyer and seller, through whichever Saudi government channel applies to that vehicle type. The sales fee is charged to the seller on a sale completed through the platform.

Make your own checks before you buy. We do not inspect, appraise or warrant any vehicle offered for sale.

13. Featured listings

Owners can pay to feature a listing for a fixed period. Featuring improves visibility. It does not guarantee bookings, a ranking position, or any particular result, and the fee is not refundable once the promotion has started.

14. Messaging, content and licence

In app chat exists so that a booking can be arranged and so that there is a record if something goes wrong. Messages, including images, are retained and can be read by our staff when we investigate a dispute, a safety report or a suspected breach.

You keep ownership of the photographs and text you upload. You grant BAHHR a worldwide, non exclusive, royalty free licence to host, store, reproduce, adapt for display and publish that content for the purpose of operating and promoting the marketplace. The licence ends when the content is removed, except for copies we must keep for legal or dispute reasons and for material we have already published.

Do not arrange payment outside BAHHR for a booking that began on BAHHR, and do not use another user’s contact details for any purpose other than the booking they relate to.

15. Reviews

Only a renter with a completed booking can review the vehicle from that booking, and only once per booking.

Reviews must be honest and must relate to the rental. We remove reviews that contain unlawful content, personal attacks, hate speech or private information, and reviews posted to extort a refund. We do not remove a review because the owner disagrees with it.

Do not offer, request or accept anything in exchange for a review, and do not review your own listing through another account.

16. Disputes

Start in the chat. Most problems are misunderstandings and are settled in a few messages.

If that does not work, either party can raise a dispute on the booking or write to support. We will look at the booking record, the chat transcript, the photographs and anything else either side provides, and we will decide how any money we are holding is handled. We will give the reason for the decision.

That decision governs how BAHHR handles the funds it holds. It is not arbitration, and it does not remove your right to bring a claim before the courts.

Raise a dispute promptly. Evidence is much weaker weeks after the event.

17. Prohibited conduct

You may not:

  • Misrepresent your identity, your age, your licence status or your ownership of a listed vehicle.
  • Use BAHHR to defraud another user, to launder proceeds, or to evade sanctions.
  • Harass, threaten or discriminate against any other user.
  • Post unlawful, defamatory, sexually explicit or hateful content.
  • List a vehicle you cannot lawfully rent out, advertise availability you do not have, or bait with a price you will not honour.
  • Scrape the platform, reverse engineer it, bypass its security controls or access it by automated means.
  • Open an account for anyone other than yourself, or keep a second account after a suspension.

We may remove content, restrict features, cancel bookings, suspend or close accounts, and report the matter to the authorities where this section is breached.

18. Intellectual property

BAHHR owns the platform, the software, the BAHHR name, the logo, the Arabic wordmark and everything we publish. Nothing in these terms transfers any of it to you. You may not use our brand without written permission, except to refer to the service factually.

19. Suspension, closure and deleting your account

You can stop using BAHHR at any time, and you can ask us to delete your account from within the app. Deletion is scheduled with a 30 day cooling off period, during which you can still sign in and cancel the request. After that period the account is anonymised.

Deletion does not cancel bookings that are already confirmed, does not settle money you owe, and does not erase records we are required to keep. For a period after deletion we retain a one way hash of the email address and phone number that were used, so that the same details cannot immediately be used to open a new account. We do not retain the address or the number themselves.

We may suspend or close an account that breaches these terms, that is implicated in fraud or abuse, or where the law requires it. Where we close an account without fault on your side, we will honour active bookings so far as practical and refund what you have prepaid.

20. Disclaimers and limits of liability

BAHHR is provided as it is and as available. We do not warrant that it will be uninterrupted or free of error, and we do not warrant the accuracy, the safety or the legality of any listing or user content.

Operating a boat, a jet ski, an ATV, a dirt bike, a buggy or a motorcycle carries a real risk of serious injury and death. You accept that risk. BAHHR is not responsible for the conduct of any user, on or off the platform, or for the condition of any vehicle.

To the fullest extent the laws of the Kingdom allow, BAHHR is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill. Our total liability to you for any claim is limited to the total fees BAHHR collected from you on the booking that gave rise to the claim, or SAR 1,000, whichever is greater.

Nothing here limits liability that cannot be limited under Saudi law, including liability for death or personal injury caused by our own negligence, or for fraud.

21. Changes to these terms

We may change these terms. The last updated date at the top of this page always shows the current version. For a change that materially affects your rights we will give notice in the app or by email at least 14 days before it takes effect. Continuing to use BAHHR after that date means you accept the change. If you do not accept it, stop using the service and close your account.

22. Governing law and venue

These terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute between you and BAHHR that we cannot resolve through support will be heard by the competent courts in Riyadh.

These terms are published in Arabic and in English. If the two versions differ, the Arabic version governs.
